Can Trump legally sell early access to Truth Social posts?

For a monthly subscription fee of up to $100,000, investors can buy early access to “market-moving” posts on Truth Social. The service, called Truth API, is the subject of a lawsuit against US President Donald Trump.

Experts agree that US President Donald Trump‘s announcements on Truth Social can influence financial markets, and that faster access could equate with profits. The service, called Truth API, is the subject of a lawsuit against Trump, who is the largest stakeholder of Trump Media. The lawsuit by the investigative journalism site The Intercept and the Freedom of the Press Foundation claims that Truth API violates the US Constitution. 

Trump Media refutes the allegations, emphasizing that the Truth Social posts are public and that paying subscribers simply access them sooner than the general public.  
DW reporter Pablo Foley Elias asks Katie Fallow, free speech attorney at Columbia University’s Knight First Amendment Institute whether Truth API violates US law. Seth Stern of the Freedom of the Press Foundation explains why his organization says it does.
