Across Africa, surrogacy is becoming an important option for people who are unable to have children on their own.
But the rules are not the same everywhere. Some countries have clear laws, while others are still deciding how surrogacy should be regulated.
South Africa has the continent’s most established legal framework. Surrogacy agreements must be approved by a High Court before pregnancy begins, and only altruistic surrogacy is allowed.
In countries such as Kenya, Nigeria, Ghana, and Uganda, surrogacy takes place, but the legal rules are often limited, unclear, or still evolving. In many cases, courts and private agreements help determine parental rights and responsibilities.
When laws are unclear, challenges can arise for everyone involved. Intended parents may face difficulties establishing legal parenthood, surrogates may have limited legal protections, and children born through surrogacy can encounter issues related to birth registration, citizenship, and legal identity.
As reproductive technology continues to advance, many African countries are being called upon to develop laws that protect the rights and interests of intended parents, surrogate mothers, and, most importantly, children.
The future of surrogacy in Africa will depend on how societies balance family-building opportunities with legal, ethical, and human rights considerations.
